Raccomandazioni controverse per scelte difficili nella pandemia. Appunti etico-giuridici su responsabilità dei medici e linee guida

Il saggio sviluppa alcune riflessioni di carattere giuridico ed etico sul rapporto tra responsabilità medica e linee guida che nel tempo hanno assunto particolare rilievo in molti ordinamenti giuridici. Le situazioni straordinarie derivanti dalla pandemia hanno reso ancora più delicata la questione, da un lato per via della mancanza di linee guida vere e proprie e dall'altro lato per il proliferare di raccomandazioni di vario genere e provenienza che hanno generato anche confusioni. Tra queste raccomandazioni hanno avuto un particolare clamore le raccomandazioni etico-cliniche della Società Italiana di Anestesia Analgesia Rianimazione e Terapia Intensiva (SIAARTI). Esse hanno dato avvio alla pubblicazione di raccomandazioni sul medesimo tema in molti altri Paesi e il saggio dà conto delle più rilevanti. Si sofferma tuttavia sul documento italiano, perchè può essere considerato il modello di linea guida, imitata anche in altri documenti segnalati, nella quale viene previsto un limite d'accesso alle terapie intensive basato sul criterio aprioristico dell'età. Ciò pone il problema non solo della eticità di un simile criterio ma anche della competenza di una società scientifica a prevedere regole che possano ledere gravemente diritti fondamentali. Il saggio critica il criterio aprioristico ed extraclinico e propone al suo posto un criterio clinico integrato in funzione delle situazioni di scarsità di risorse e di emergenza. Tale criterio integrato sarebbe più rispettoso della competenza dei medici e valorizzerebbe la loro professionalità, senza invadere l'ambito e la competenza delle scelte politiche che spettano alle istituzioni democratiche.
