L'Autore riporta le successive formulazioni che, in seno al Comitato di bioetica del Consiglio d'Europa, ha subito il testo dell'art. 9 della Convenzione sui diritti dell'uomo e la biomedicina (cosiddetta Convenzione di Oviedo, 1997), che tratta delle indicazioni che la persona può esprimere, in forma di desideri, in merito ai trattamenti sanitari applicabili in condizioni vitali in cui può essere impossibile esprimere consenso o dissenso.
Il documento del comitato Nazionale di Bioetica, dal titolo Dichiarazioni anticipate di trattamento, è conforme alle indicazioni del Consiglio d'Europa.
