La sentenza della Corte costituzionale n. 5 del 2018 è l'occasione per affrontare la questione dei vaccini sui minori in Italia. Questo paper si propone di discutere il complesso tema con gli strumenti propri dell'analisi filosofico- giuridica. A tale proposito, saranno passate in rassegna le principali obiezioni alla pratica vaccinale minorile, per capirne la sostenibilità e per opporre differenti ragioni giustificanti. Saranno in particolare chiariti i fraintendimenti tra liberà di scelta e di cura, riguardo all'esercizio del diritto alla salute per i minori.

The ruling by the Italian Constitutional Court n. 5/ 2018 is an opportunity to address the issue of childhood vaccination. This paper aims to discuss the complex theme from an legal and philosophical perspective. In this regard, the main objections to the minors vaccination practice will be reviewed, to understand their sustainability and to oppose other justifying reasons. In particular, the misunderstandings between freedom of choice and freedom of care regarding the exercise of children's right to health will be clarified.
