El presente trabajo aborda el análisis desde la perspectiva biojurídica, de la propuesta de despenalización del aborto por causal, específicamente las referidas a embarazos causados por violación y con malformaciones fetales incompatibles con la vida. Lo que se busca es dar una respuesta a los planteamientos de la legalización del aborto desde el reconocimiento del derecho a la vida del concebido y de su dignidad. Asimismo, establecer los límites a los derechos de la mujer a la libertad sexual, al libre desarrollo de la personalidad, a la igualdad y a la salud que sustentan la despenalización del aborto, desde la perspectiva de la condición de "otro" que ostenta el concebido. Todo ello, con el fin de contribuir a un análisis integral de lo que significaría el reconocimiento del aborto como "derecho": un grave retroceso legislativo y social.

The present work approaches the analysis from the biolaw perspective, of the proposal of decriminalization of abortion by causal, specifically those referred to pregnancies caused by rape and with fetal malformations incompatible with life. What is sought is to provide an answer to the legalization of abortion from the recognition of the right to life of the conceived and its dignity. Likewise, it establishes the limits to women's rights to sexual freedom, to the free development of personality, to equality and to health that sustain the decriminalization of abortion, from the perspective of the condition of "other" that holds the conceived. All this, in order to contribute to a comprehensive analysis of what the recognition of abortion would mean as "right": a serious legislative and social setback.
