JF - Medicina e Morale JA - MedMoral VL - 63 IS - 1 SE - Original Articles DO - 10.4081/mem.2014.68 UR - https://www.medicinaemorale.it/mem/article/view/68 SP - AB - Nel testo proposto come nuovo rifacimento del Codice deontologico, presentato negli ultimi giorni di giugno 2013 dalla Federazione degli Ordini dei Medici italiani ed ancora in procinto di essere approvato, permane una mancanza di indicazioni su alcuni aspetti non trascurabili della professione medica attuale, quali l’asimmetria del rapporto medico-paziente, la distribuzione delle risorse (sempre più ridotte) ed il loro impiego, e soprattutto la natura morale, non solo tecnica, delle decisioni e dell’operare del medico. La tendenza a ridurre il rapporto con la persona sofferente a semplice prestazione tecnica, anche attraverso l’impiego di nuovi termini definitori del paziente (es. persona assistita), comportano una diversa relazione e suggeriscono una riduzione della autonomia del medico, limitando la possibilità per il sanitario di appellarsi alla sua “coscienza”. Non viene inoltre adeguatamente considerata, nel testo proposto, la particolare responsabilità di chi esercita una professione sanitaria. Responsabilità che nasce dalla peculiarità della relazione medico-paziente (o medico cliente), tanto più sentita quanto più la “relazione” assume una valenza terapeutica, come, ad esempio, in ambito psichiatrico o in particolari situazioni critiche. Le questioni riproposte da questa ulteriore riscrittura del codice italiano meriterebbero perciò una maggiore attenzione da parte dei medici italiani, che dovrebbero cercare di identificare prima i principi sui quali l’intera comunità dei professionisti possa trovare dei punti su cui basare il suo agire, seguendo un comune sentire che, a bene vedere, non potrà non tenere conto di valori di natura etica e di una più generale riflessione sulle basi filosofiche della medicina. ---------- In Italy the rules of professional conduct for doctors are going to change. Over the last decade the “Federazione degli Ordini dei Medici” has approved more than four different editions of the professional code and, last June, a new version was submitted. In spite of the lively debate the text that has been proposed does not give any detail about the asymmetric relationship between doctor and patient, the use of the always limited financial resources and their employment; what is more the moral aspect of the medical conduct is not dealt with. The medical conduct is not only a technical skill as suggested in the code (where the relationship doc/patient seems to get poorer) but something deeper and more complex and, calling patients in a different way (i.e. assisted person) is not enough and doesn’t help. Unfortunately, lately, the trend has been to reduce the relationship between doctor and patient to a simple technical skill. The new code seems to forget that the aim of clinical ethics is to improve the quality of patient care by identifying, analysing and attempting to solve the ethical problems that rise in practise. Medical ethics has not to be analysed only in terms of obligations between a single physician and a single patient because, as a matter of fact, doctors have an obligation to their patients as well as to their community. The new code has completely neglected the moral responsibilities of the profession inside a their moral community, as a group dedicated to a common set of moral precepts. To sum up, in the last submitted edition there are several critical points which are worth of attention. The Italian physicians should identify the obligations, values, rules of their professional conduct and, at the same time, keep in mind the buried roots from which the medical profession conduct has grown. Only in this way the still living philosophy of medicine will be kept in adequate consideration and will help to give a better welfare. ER -
